High court to rule on council rights to charge fish farms
Crown to investigate a police officer for allegedly assaulting fish farm owner
A federal court is hearing a lawsuit that alleges the Nova Scotia municipal government failed to meet the minimum standards for police accountability, and has now ordered the province to implement new laws.
The civil suit was filed by the town of Whitehorse on Dec. 3, 2013. It alleges «at least four citizens have been severely injured by police officers and that at least three residents are suffering serious injuries from police officers.»
Court documents filed in the court show the town, which uses the term «fish farm,» said it has met the legal threshold but now has to provide additional training for police and make adjustments to the department’s «criminalization of trespass and its enforcement policies» to ensure it follows all current laws.
«The evidence shows that [Whitehorse is] not only complying with all law but also being the most progressive municipality in the country in their use of the police,» said Andrew Kincaid, the lawyer representing residents.
The complaint says the residents have filed 12 separate complai포항출장마사지강남 마사지nts to the City of Whitehorse about various breaches of their rights by the provincial government since 2011.
There are claims the government, including the provincial government’s commissioner of human rights, are failing to do their job by not «releasing information as required» and by not conducting adequate training of police officers for use in the communities.
Nova Scotia says the fish farm residents «have been and still are the victims of unreasonable, unwarranted, and unnecessary force.»
The municipal government, though, argued the residents should not have to pay damages to the fish farm owners, who also oppose the town’s use of the term fish farm.
They also say the town has paid damages to one of its employees and there are multiple insurance coverage claims that should be paid for by the public.

The other disagrees with the authority of the town’s police officers.
